Terms and Conditions

1. APPLICATION

   These Terms and Conditions apply to the purchase of vehicles ("Cars/Vehicles") from Castleview Cars, a company registered in England and Wales (Company No: 05584415), with its registered office at Unit 3 The Powerhouse, Woodthorpe Road, Ashford, TW15 2RP and its trading address at 14 Shirley Avenue, Windsor, Berkshire, SL4 5LH ("Seller"). These Terms and Conditions govern the relationship between the Buyer and Seller and shall supersede any previous agreements unless otherwise stated in writing by both parties.

   No other terms apply unless explicitly agreed upon in writing by both parties.

2. DESCRIPTION OF GOODS

   • Vehicle details are provided on the Seller’s website (https://www.castleviewcars.com) or third-party platforms.
   • The Buyer acknowledges reliance only on written representations from the Seller.
   • Descriptions provided are indicative and not binding; specifications may change due to regulatory or safety requirements.
   • The Seller shall not be held responsible for discrepancies in descriptions across third-party platforms.

3. PRICE & PAYMENT

   1. Price

      • The total purchase price ("Price") of the vehicle(s) is as detailed in the invoice provided to the Buyer.
      • The Price is subject to change based on external factors beyond the Seller’s control, such as fluctuations in material/labour costs, exchange rates, and regulatory duties.
      • Any changes to the Price will be communicated to the Buyer in writing before delivery or collection.
      • The Price does not include administrative charges, transportation fees, or any additional services unless expressly specified.
      • Second-hand vehicles are sold under HMRC’s VAT Margin Scheme, where applicable, and VAT is included within the sale price but not itemised separately.

   2. Payment Methods

      • Accepted Payments: Visa, Mastercard, Bank Transfer, Cash, and Finance arrangements.
      • Cash Payments: Maximum £1,000 per vehicle purchase.
      • Credit Card Payments: Maximum £1,000 per vehicle purchase.
      • Finance Arrangements: Any vehicle financed through an external lender must be pre-approved by the Seller, and administrative fees may apply.
      • Part Payments & Deposits: Deposits and part payments made towards a purchase are strictly non-refundable.
      • Late Payments: Failure to make the full payment within 24 hours of the agreed date will result in the forfeiture of the agreement and loss of any deposit paid.

4. ADMINISTRATION FEES

   A compulsory Administration Fee applies based on customer type:

   • Retail Customer (Vehicle Value £9,750 and above): £199
   • Retail Customer (Vehicle Value below £9,750): £99
   • Export Customers: £199
   • Retail Customers using outside finance brokers: £299
   • Motoring Trade Customers: £199

   This fee covers the cost of essential documentation, vehicle preparation, and processing required for the sale.

5. DEPOSIT & CANCELLATION

   • A non-refundable deposit is required to secure the purchase and confirms acceptance of these Terms and Conditions.
   • Deposits will not be refunded under any circumstances unless the Seller is unable to supply the vehicle as agreed.
   • If full payment is not received within 24 hours of the agreed due date, the agreement is forfeited, and no refund will be issued.

6. VEHICLE COLLECTION & INSPECTION

   • The Buyer is required to inspect the vehicle upon collection or delivery.
   • Any defects, damages, or discrepancies must be reported in writing within 24 hours.
   • The Seller will assess and resolve valid issues within 28 days from the date of purchase.
   • The Seller shall not be held liable for any claims made after the 24-hour inspection period.

7. RETURNS POLICY

   1. General Returns Conditions

      • Returns are accepted only within 28 days from the date of purchase and require prior written approval from the Seller.
      • The Buyer must provide documented proof that the defect existed prior to collection/delivery.
      • The Seller reserves the right to repair the vehicle rather than issue a refund.
      • The Buyer is responsible for all return-related costs, including vehicle recovery and any associated charges.

   2. Deductions for Returns

      • Administration fee + 5% of vehicle price as a restocking fee.
      • Mileage charge: 45p per mile (beyond 100 test miles).
      • Registration transfer costs.
      • Repair costs for any damage caused by the Buyer.

   3. Warranty Cancellation Fees

      • 1-Year Warranty: £99
      • 2-Year Warranty: £199
      • 3-Year Warranty: £299

8. RISK & TITLE

   • The risk of loss or damage passes to the Buyer upon collection or delivery.
   • Legal ownership ("title") of the vehicle remains with the Seller until full payment has been received and cleared.

9. WARRANTY

   • Standard warranty: 3 months or 1,500 miles (whichever occurs first) covering parts & labour only.
   • Extended warranties are available at an additional cost.
   • Exclusions and inclusions are detailed in the warranty documentation provided.

10. LIABILITY

    • The Seller shall not be liable for:

      • Loss of profits or consequential damages.
      • Normal wear and tear, misuse, negligence, or unauthorised modifications.

    • The Seller’s liability is not excluded for:

      • Death or personal injury caused by negligence.
      • Fraud or fraudulent misrepresentation.

11. PART-EXCHANGE VEHICLES

    • The Seller will accept part-exchange vehicles under the following conditions:

      • The vehicle is in the same condition as originally appraised.
      • The vehicle has no outstanding finance, OR any existing finance will be factored into the valuation.
    • The Seller reserves the right to adjust the valuation should undisclosed faults or discrepancies be identified.
    • If the part-exchange vehicle has an outstanding finance balance, the amount will be deducted from the trade-in value and settled directly with the finance provider.

12. COMMUNICATION

    • All communications must be in writing and will be deemed received:

      • Immediately if delivered in person.
      • Upon receipt confirmation via email.
      • Five business days after posting by standard mail.

13. GOVERNING LAW & JURISDICTION

    • These Terms and Conditions are governed by English law.
    • Any disputes shall be resolved in the courts of England and Wales.
